15. Unsuccessful Deliveries

a. Prescription Lenses Disclaimer:

• The Apple Vision Pro is currently sold without any prescription lenses.
• Customers requiring prescription lenses need to be aware that additional lenses will be required for optimal use.
• Prescription lenses compatible with the Apple Vision Pro will be available for purchase separately in our store at a later date. We will notify our customers when these become available.

b. Light Seals and Headbands Sizing Information:

• At present, it is not possible to choose specific sizes for the Light Seals and Head Bands of the Apple Vision Pro.
• Due to this, there might be instances where the fit of these components may not be ideal for every user.

17. Pre-order Deposit and Cancellation Policy

For certain high-demand products available for pre-order, iOasis may require a deposit at the time of placing a pre-order. The following conditions apply to pre-order deposits:

a. Cancellation and Refund: Customers have the right to cancel their pre-order and request a full refund of the deposit within 7 days of placing the pre-order.

b. Non-refundable Deposit: If a customer decides to cancel their pre-order after the 7-day period, the deposit becomes non-refundable. However, the customer will not be billed for the remaining amount of the order.

c. Processing Phase: Once a pre-order has entered the processing phase, indicating that preparation for dispatch or customization has begun, the deposit becomes non-refundable under any circumstances.

18. Dispute Resolution and Legal Sanctions

By using the services of our online store, the Customer accepts these terms and conditions, which include, among others, provisions regarding the resolution of any disputes and sanctions for actions inconsistent with the terms of the agreement. e. Arbitration will be conducted by an independent arbitrator appointed by our company, with both parties committing to respecting his final verdict.

Sanctions for Chargeback Claims
a. The client agrees that in the case of filing a chargeback claim, our company will take all appropriate steps to resolve the situation in accordance with applicable legal regulations, including contacting the client and the financial institution to clarify the circumstances.
b. In the event it is determined that a chargeback claim was made without justified reason and constitutes a violation of the agreement terms, we reserve the right to take appropriate legal actions to seek compensation for the incurred losses, always in a manner consistent with applicable law and after exhausting the possibility of an amicable resolution.

Compensation and Sanctions
a. In the event of a breach of the agreement terms by the Client, including the unjustified filing of a chargeback claim, our company will seek full compensation for all damages resulting from such actions, in accordance with applicable law.
b. Additionally, in extreme situations, our company may seek the imposition of maximum legal sanctions, including imprisonment, if the Client’s action qualifies as a criminal offense.

Final Provisions
a. These provisions aim to protect both Clients and our company against dishonest actions and apply to all transactions made within our online store.
b. Any actions taken by our company to seek compensation or sanctions will be carried out with the highest ethical standards and in accordance with applicable law.
